About McDermott Will & Emery

A Chicago institution since the 1930s, McDermott Will & Emery has, in recent decades, broadened its gaze to new markets in the United States and abroad. The strategy has paid off in spades, with McDermott firmly ensconced among the world’s largest and most elite law firms.

A Windy Start

McDermott opened for business in 1934 as a tax firm run by Edward H. McDermott and William M. Emery. A mere seven years later, the third and final name partner was added in corporate specialist Howard A. Will. The firm’s name has remained the same ever since, a remarkable feat of continuity in the modern atmosphere of shortened firm names, legal mergers, and buyouts. McDermott added an estate planning division in 1941, and by 1944, the firm had burgeoned to 16 lawyers. Over the next half century and into the 21st century, the firm expanded both domestically and internationally. Today, McDermott is home to more than 1,100 lawyers across 20-plus offices around the world.

Flexing Their Practice Area Muscles

While the firm is still known for its strength in tax, McDermott’s reach has expanded over the decades. The firm counsels its clients on newer areas such as life sciences, renewable energy, and privacy law, which complement its more traditional practices like M&A, antitrust, health care, intellectual property, litigation, real estate, and insurance.

McDermott is a leader in health care law, holding the No. 1 spot in Vault’s Health Care rankings. The firm uses multidisciplinary, cross-border teams to handle its clients’ sophisticated issues. Hospitals, health private equity funds, digital health companies, home health agencies, hospices, medical device manufacturers—and more—call on McDermott for advice.

The firm also has a stand-out IP department, with experience in copyright, domain names, International Trade Commission matters, patents and patent litigation, trade secrets, trademarks, and unfair competition. The firm is a regular before the USPTO, including in post grant review proceedings. Among the industries the firm’s IP attorneys serve are energy, life sciences, media, and telecommunications.

News & Awards


March 2019

The American Lawyer reported on McDermott’s impressive year in which it surpassed the $1 billion mark in revenue for the first time in its 85-year history. Chair Ira Coleman said the firm will remain committed to “the happiness factor” while continuing growth and using innovative ways to differentiate itself.

February 2019

The Recorder reported on the opening of McDermott’s new San Francisco office in the city’s tallest building. The article describes how the new office sends a message about the firm’s commitment to the San Francisco market and to expanding its footprint on the West Coast. The article also touches on the stunning views (including a 360 degree view of the Bay!), colorful artwork, and the fresh, modern look of the new office space.

December 2018

A jury in the United States District Court for the District of Massachusetts found McDermott pro bono client Joseph Matthew “Matt” Evanosky not guilty on all counts in a trial stemming from his work at the New England Compounding Center (NECC). Evanosky was tried alongside five co-defendants and was the only one to be fully acquitted after seven weeks of testimony.

November 2018

McDermott advised CVS Health Corp. on its approximately $70 billion cash and stock purchase of health insurer Aetna Inc., which closed on November 28, 2018. In connection with this merger, McDermott also represented CVS Health on the divestiture of Aetna Inc.’s standalone Medicare Part D prescription drug plans to a subsidiary of WellCare Health Plans, Inc.

  • McDermott secured a significant victory on behalf of specialty food company Dalmatia in the case of Dalmatia Import Group, Inc. v. FoodMatch Inc. et al. The final judgment, entered May 3, 2017, was the first obtained by any law firm under the Defend Trade Secrets Act.
  • McDermott secured a landmark ruling in the ongoing case of Dawson-Damer v. Taylor Wessing. This case continues to clarify important aspects of the Data Protection Act and the rights of individuals to access their personal data.
  • Two federal lawsuits brought by McDermott resulted in the U.S. Army issuing updated rules governing religious liberty that significantly improved the standards for Sikhs and other religious minorities looking to serve their country with their religious articles of faith intact.
